	Purchasing Terms & Conditions for Sample Packs CUSTOMER QUESTIONS: Smart Lid Systems are totally committed to our customer's satisfaction, for all questions related to our product please feel free to contact us at: Email: sales@smartlidsystems.com AVAILABILITY: Smart Lid Systems is dedicated to offering our unique product to the world market. We use Australia Post for ALL sample pack shipments and the country limitations are only bounded by their postal resources. FORMS OF PAYMENT ACCEPTED: Credit Card and PayPal. All payment will be processed through PAYPAL an EBAY owned company, where all major credit cards are accepted. PAYPAL is renowned for its high level of security and a reputable payment handling company. For more information on their security protection please visit the PayPal web site. PRICES & CURRENCIES ACCEPTED: All prices are shown on the website in US Dollars. All payments must be made by via PayPal and only cards accepted by PayPal can make payments. All currencies will be converted to US Dollars and you will be liable for any exchange rate charges made by your card provider. SALES TAX: Australian customers are required to pay Goods and Services Tax (GST). Note that all prices are displayed exclusive of G.S.T. and it is only added at checkout time for Australian customers. International customers are not required to pay G.S.T. and as such it will not be added to their cart. SHIPPING: Shipping to most locations takes between 5 and 12 working days from date of shipment. A fixed Shipping and Handling cost of US$10 is added to each item. No tracking of goods is available for this shipment, therefore it is the responsibility of the customer to ensure their correct shipping address is entered. No refund will be issued for an incorrectly stated shipping address. Where you have purchased a Product that is to be dispatched overseas, delivery time may take up to 3 weeks. Smart Lid Systems makes every effort to deliver your Product according to the estimated delivery times provided by Smart Lid Systems at checkout. The estimated delivery times are in business days (Monday through Friday) excluding Public holidays. Although every effort is made to ship your Order according to the estimated delivery times provided, estimated ship times may change due to changes in supply or circumstances beyond our control. If your Product has not arrived after the estimated delivery time, please contact us at sales@smartlidsystems.com Title and risk of loss to all Products will pass to you on delivery. ORDER / PAYMENT PROCESS: 1) Payment is taken as soon as you place your order and will be debited from your credit card or PayPal account before the dispatch of the goods you have purchased. 2) Upon processing a transaction, PayPal will issue you with an electronic transaction receipt which will be sent to the email address you provide. Smart Lid Systems is wholly owned by Noshmell Pty Ltd, ABN: 48002444528, of PO Box 1836, Bondi Junction, NSW, 1355, Australia, thus for billing purposes our parent company name will appear on your credit card statements. 3) Smart Lid Systems will email the customer once the product has been packed and is ready for shipping. 4) We will confirm acceptance of your order when we send you an email confirming shipment of the goods you have ordered. 5) If we cannot process or accept your Order after payment is received we will contact you by email or telephone. 6) Payment processing will not begin until we receive all the information we need. 7) Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day. Business days are Monday through Friday, excluding NSW Public holidays. We process credit card and PayPal payments after you click the "Submit My Order" button. RETURNS & EXCHANGES: Smart Lid Systems is committed to providing the best customer service available. Smart Lid Systems will only accept a return for damaged or goods that do work properly, providing that you return the unused product to Smart Lid Systems. Refunds will only be made if a claim is made within 7 days of receipt of the goods and the damaged goods are returned to us within 28 days of receipt of the goods. For a return request email sales@smartlidsystems.com No refunds, credit or replacements are offered if you have changed your mind about the product, make an incorrect choice, or failed to verify and accurately provide information when placing an Order. Refunds will only be offered where a replacement Product can not be provided. LIABILITY: We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. Our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question. CREDIT CARD FRAUD: Whilst Smart Lid Systems employs the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, Smart Lid Systems will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner. GENERAL: These Terms and Conditions together with your Order constitute the entire Contract between us and you for the supply of Products. No other Terms and Conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email. Color changing lids are not to be exposed to direct sunlight for extended periods of time. You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of Smart Lid Systems. Any unauthorized assignment shall be deemed null and void. If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provisions in question shall not be affected thereby. Under the Trade Practices Act 1974 ("Act"), where implied conditions and warranties cannot be excluded, any liability in Smart Lid Systems for breach of such conditions and warranties (other than a condition or warranty implied by section 69 of the Act) shall be limited, at the option Smart Lid Systems, to the replacement of the Product(s) or the re-supply of the same Product(s); the payment of the cost of replacing the Product(s) or of acquiring equivalent Product(s). Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition. Smart Lid Systems reserves the right to change the Terms and Conditions of sale at any time. FORCE MAJEURE: Smart Lid Systems shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Smart Lid Systems, and Smart Lid Systems shall be entitled to a reasonable extension of time for the performance of such obligations. GOVERNING LAW: These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales. PRIVACY POLICY: Smart Lid Systems is committed to protecting your privacy. Smart Lid Systems will use your personal information solely for payment and billing purposes. By placing your order, you agree that we may store, process and use data collected from your order form for the purposes of processing your order. If you so indicate on the appropriate section of your order Form, by placing your order you also agree that we may use such data, other than credit card details, in order to provide you with information from time to time on other Smart Lid Systems products that may be of interest to you. None of your entered information will be sold or transmitted to any other company.
